Terms of Service

These Terms of Service ("Terms") govern your use of the Hol Fitness Journal mobile application ("the App"), operated by AsavaTech LLC ("we," "us"). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.
Not Medical Advice
- Hol Fitness Journal is a fitness and nutrition tracking tool provided for general informational and self-tracking purposes only. It is not a medical device and does not provide medical, healthcare, nutritional, or professional advice.
- The App does not diagnose, treat, cure, or prevent any disease or health condition.
- Always consult a qualified physician or healthcare professional before starting any exercise program, changing your diet, or relying on any information in the App — especially if you are pregnant, have a medical condition, or take medication.
- You are responsible for exercising safely. Physical activity carries inherent risks, including injury. You assume all risk arising from your use of the App and any activities you undertake based on it. Stop and seek medical attention if you experience pain, dizziness, or other warning signs.
Nutrition & Health Data Accuracy
- Food and nutrition information is provided by FatSecret, a third-party database, and may be incomplete, outdated, or inaccurate. Barcode scans can occasionally match the wrong product. Always check product packaging for authoritative nutrition information.
- Health metrics shown in the App are read from Apple Health or Health Connect and are only as accurate as the devices and sources that produced them.
- Do not rely on the App for decisions where accuracy is critical (for example, managing a medical condition or a severe allergy).
Your Data and Backups
- Your data is stored locally on your device. You are responsible for keeping your own backups.
- If you delete the App, reset your device, or lose your device, your data may be permanently lost. The App includes data export and backup tools for this purpose; we are not responsible for any loss of data.
License
- Subject to these Terms, you are granted a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your personal, non-commercial use.
- You may not copy, modify, reverse-engineer, redistribute, or resell the App except as permitted by applicable law or the app store from which you obtained it.
- The App, its content, and its branding remain the property of their respective owners. The data you enter remains yours.
- The App is a one-time purchase. There are no subscriptions, and the App contains no in-app advertising.
Third-Party Services
- The App relies on third-party services including FatSecret (food data), Apple Health / Health Connect (health data, with your permission), and the app store through which you obtained the App. Your use of those services may be subject to their own terms and policies.
No Warranty
- The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any data or calculation it provides is accurate.
Limitation of Liability
- To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or health outcomes, arising from your use of (or inability to use) the App.
- Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
Changes to These Terms
- We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
Governing Law
- These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules.
